This part describes changes to the Terms, governing law and jurisdiction, mediation, personal data and contact.

1. Changes to the Terms

  • KiftMe may amend these Terms to reflect changes to the service, its organisation or the regulations.
  • The applicable version is the one in force at the time of your use; the date of the last update appears at the top of each part.
  • In the event of a substantial change, you are informed by an appropriate means (email or via the app) with a reasonable notice period, for example thirty (30) days, before it takes effect. Continued use after that date constitutes acceptance; failing agreement, you may stop using the service and close your account before it takes effect.

For partner businesses, specific notice arrangements may apply.

2. Governing law and jurisdiction

  • These Terms are governed by French law.
  • If you are a consumer: failing an amicable resolution, you may bring the matter before the court of your place of residence or that of the place where you were located when the contract was concluded, in accordance with consumer-protection rules.
  • If you are a professional: any dispute falls under the courts having jurisdiction over KiftMe’s registered office, subject to mandatory rules of public policy.

3. Consumer mediation

In accordance with the French Consumer Code, after a written complaint sent to KiftMe has remained unsuccessful, you may, as a consumer, use a consumer mediator free of charge with a view to the amicable resolution of the dispute.

The contact details of the competent consumer mediator are provided to you in the legal notice and when your complaint is handled.

4. Personal data

The processing of your personal data is described in the Privacy Policy, a separate document, broken down according to your profile (individuals, businesses, point of sale).

Acceptance of these Terms does not amount to consent to data processing: the Privacy Policy is information provided to you.

5. Miscellaneous

  • Entire agreement: these Terms, together with the Privacy Policy and the legal notice, constitute the agreement between you and KiftMe regarding the service.
  • Severability: if a clause is held to be invalid or unenforceable, the other clauses remain fully applicable.
  • No waiver: KiftMe’s failure to enforce a right does not constitute a waiver of that right.
  • Assignment: you may not assign your rights and obligations without KiftMe’s agreement; KiftMe may transfer these Terms in the context of a reorganisation, without diminishing your rights.
  • Language: in the event of any discrepancy between the language versions of these Terms, the French version prevails.

6. Contact and complaints

  • For any question or complaint, you can contact KiftMe through the means indicated in the app and in the legal notice.
  • The full details of the publisher appear in the legal notice (separate document).
  • Any written complaint is handled within a reasonable time.
