Account and user

This part describes access conditions, your obligations, account security, suspension and termination.
1. Access conditions and minimum age
The service is reserved for natural persons with the capacity to contract and aged at least 15. By creating an account, you declare that you are at least 15 years old.
- Registration and login are done by email, with verification via a one-time code.
- Access is refused below the age of 15, the French digital consent threshold. KiftMe does not offer a parental-consent mechanism: a minor under 15 cannot create an account.
- “Individual” accounts are intended for personal, non-professional use. Businesses are covered by the “Businesses” part.
KiftMe may close any account that appears to have been created in breach of the age condition.
2. Account creation and consents
Creating an account requires providing accurate information and accepting these Terms of Use and the Privacy Policy.
- Acceptance of the Terms of Use and the Privacy Policy is mandatory to create an account; without it, the account cannot be created.
- Marketing communications are optional and based on your consent, which you can withdraw at any time.
- You choose a unique username and a password that complies with the security rules.
KiftMe keeps proof of your acceptance (version and date). Changes to the Terms are dealt with in the “Legal provisions” part.
3. User obligations
- Provide accurate, up-to-date information and keep a valid email address.
- Use the service in good faith, in accordance with these Terms and the law.
- Only give a Kift for the benefit of a loved one, for the locked experience.
- Do not impersonate a third party or provide false or misleading information.
- Do not circumvent the service’s limits, caps, checks or suspensions, including by creating new accounts.
- Do not use unauthorised automated means (bots, scripts, automation).
Fraudulent behaviour and its sanctions are detailed in the “Fraud and sanctions” part.
4. Account security
- You are responsible for the confidentiality of your credentials and for any activity carried out from your account.
- A strong password is required. Two-factor authentication is available and may be required for sensitive actions.
- You must inform us without delay of any unauthorised use of your account.
- KiftMe implements security measures, including an anti-bot check at login; you undertake not to circumvent them.
5. One account per person
Each person may hold only one “individual” account. Creating multiple accounts, or using several accounts to circumvent limits, caps or a suspension, is prohibited.
KiftMe may suspend or close duplicate accounts, or accounts created to circumvent these rules.
6. Suspension and termination

KiftMe may restrict, suspend or terminate your access in the event of a breach of these Terms, fraudulent or illegal use, a risk to the service or to other people, or to comply with the law.
- Depending on the severity: a warning, a temporary suspension, or permanent termination of the account (a ban).
- In the event of a serious breach - in particular fraud, collusion or illegal use - termination may be immediate, permanent and without notice, and may give rise to a report to the competent authorities (see “Fraud and sanctions”).
- In other cases, KiftMe endeavours to inform you and, where appropriate, to observe reasonable notice.
By you
- You can close your account at any time from your settings; deletion requires explicit confirmation, and a reinforced verification if two-factor authentication is enabled.
- Closure is blocked while you have Kifts in progress: you must first use them, cancel them or obtain a refund.
7. Fate of Kifts and data
- When the account is closed, Kifts in progress must first be resolved (used, cancelled or refunded).
- Closure leads to the anonymisation of your account. To meet accounting and legal obligations, the financial data relating to your payments and Kifts is retained.
- The details (durations, retained data, your rights) are set out in the Privacy Policy.
- Data held by Stripe is governed by Stripe and its own obligations.
