Terms of Use

1. Purpose and acceptance of the Terms

These Terms of Use (the “Terms”) set out how to access and use the KiftMe service (the “service”), published by RELOKE LTD, a company registered in England and Wales, which operates the service under the trading name “KiftMe” (the “publisher”; its full details appear in the legal notice).

• By creating an account or using the service, you accept these Terms.
• You must have the capacity to contract and the required minimum age (see “Account and user”).
• These Terms apply to individuals (Kifters, recipients) and, for the provisions that concern them, to partner businesses.

If you do not accept these Terms, you cannot use the service.

2. Definitions

• KiftMe / the publisher: RELOKE LTD, a company registered in England and Wales, operating the service under the trading name “KiftMe” (see legal notice).
• Service: the KiftMe platform (app and website) for creating, giving and using Kifts.
• Kift: a prepaid recommendation - an amount locked onto a specific experience (service or product), usable by a loved one at a business.
• Kifter: the person who creates and funds a Kift; they are the one recommending the experience.
• Recipient: the person who receives the recommendation. They are free to accept it or not: claiming a Kift is never an obligation, and an unclaimed or declined Kift is refunded to the Kifter.
• Partner business (Single Mode): a business with a KiftMe account, a party to these Terms.
• Named business (self-service): a business merely designated by a Kifter, not a party to these Terms.
• Stripe: the payment provider operating payments and payouts.

3. General overview of the service

KiftMe is a service that lets you give a locked experience to a loved one, at a partner business or not.

• The Kifter creates and funds a Kift; the recipient uses it and proves its use.
• Two modes coexist: Single Mode (partner business) and self-service (non-partner business). See “The service”.
• The details of how it works, payments, refunds, fraud and liability are set out in the dedicated parts.

4. Contractual documents and references

These Terms form a whole together with the following documents:

• The Privacy Policy (individuals, businesses, point of sale), which describes the processing of your data.
• The legal notice, which identifies the publisher and the host.
• Where applicable, Stripe’s terms applicable to payments.

In the event of a contradiction, the specific provisions of a part prevail over the general provisions for the subject they address.
