1. Who we are and what you agree to#
KiftMe is published by KIFTME LTD, a company registered in England and Wales (no. 17037940), 20 Wenlock Road, London, N1 7GU, United Kingdom (“KiftMe”, “we”).
By creating an account or using KiftMe (website and apps), you agree to these terms, the KiftMe Rules and, if you subscribe, the KiftMe Plus terms. The privacy policy explains what we do with your information, the cookie policy what is stored on your device, and our child safety standards how we protect minors.
Order of documents: the KiftMe Rules detail what is allowed; the KiftMe Plus terms complete these terms for the subscription and prevail over them on payment, duration and cancellation. The privacy policy takes nothing away from your rights. If the French and English versions differ, the version in your language applies to you.
2. KiftMe’s words#
- Subject: a question or theme someone proposes, with a title and, if they wish, a text, images or a link (the Source).
- Expression (your answer): what you write about a Subject, in your own words.
- Mirror: the summary of a Subject’s answers. It shows the main ways of seeing and, if the Subject allows it, the share of each, without anyone’s name.
- Portrait: the themes that come up in the answers you chose to add to it. Only you see it.
- Resonance: when KiftMe notices that your answers resonate with another person’s, it suggests you to each other; you only discover each other if you both say yes.
- Public link / private link: how a Subject is shared. Public: everyone can see it. Private: only those who have the link.
- KiftMe Plus: the paid subscription, for adults only.
3. What KiftMe offers#
For free: creating and sharing Subjects, answering them, seeing the Mirror of the Subjects you answered, your Portrait, Resonances, messages with the people you discovered, Subject search, notifications.
With KiftMe Plus: exploring the Mirror in more depth (by age, emotion, place and argument), the history and links of your Portrait, and understanding who answers your Subjects. These analyses are always about groups: they never show one person’s answer, nor a group of fewer than 3 people, and refuse questions that would target someone. Answers from 15 to 17-year-olds are never included.
These terms describe the service as it exists today; they do not promise future features.
4. Who can use KiftMe#
You must be at least 15. Some US states require a parent’s consent for minors on social networks; if you live there, the minimum age is 18 in Mississippi and Tennessee, and 16 in Georgia and Florida.
Your date of birth must be accurate. An account opened by someone too young, or with a false date, is deleted. From 15 to 17, special protections apply: your profile is never public, Resonances and messages only connect you with people aged 15 to 17, KiftMe Plus is not offered to you and your answers never appear in its analyses (see the privacy policy and our child safety standards).
You may not use KiftMe where the law forbids it, in particular if you are on a sanctions list of the United Kingdom, the European Union or the United States, or if you are in an embargoed country or region.
5. Your account and its security#
- One account per person, with your real first name. Do not pretend to be someone else.
- You sign in with a code sent to your email address, a password, or your Apple or Google account. Keep these to yourself: what is done from your account is your responsibility, unless someone used it without your permission.
- In Settings, you see the devices signed in and can sign them out. If you think someone is using your account, sign everything out, change your access and tell us from Settings → Assistance or at [email protected].
- If an account seems to be used by someone else, we may protect it: close its sessions, ask for a new verification, or suspend it while we return it to the right person.
- You can pause or delete your account from Settings (see “Suspension, termination and deletion”).
6. What you post#
Your Subjects, answers, images and messages stay yours. So that KiftMe can work, you grant us a free, worldwide, non-exclusive licence to host, reproduce, adapt (for example resize an image) and display them, and to analyse them, including with artificial intelligence tools, to produce the Mirror, your Portrait and Resonances, and to check that they follow the rules. This licence is only used to run and improve KiftMe.
It does not allow us to use your content in advertising, to sell it, or to hand it to others to train artificial intelligence models. If we ever wanted to show one of your Subjects when talking about KiftMe, we would ask you first.
The licence ends when you delete the content or your account, except for what remains visible to others (for example a Subject they answered, detached from your name) and what we must keep under the privacy policy.
You must have the right to post what you post: no image or text from someone else without their permission, no photo of a person who would not agree.
7. Who sees what#
- A public Subject is visible to everyone, even without an account, and appears in KiftMe search. We do not offer it to search engines, but anyone who has its address can open it and pass it on.
- A Subject shared by private link is only visible to those who have the link. The link can be forwarded: choose who you send it to. People who open it see the Subject, never the Mirror before they answer, nor who created the link, nor who answered.
- Your answer is never shown as written, nor with your name. People who answered the same Subject see the Mirror: a summary of the ways of seeing. When few people have answered, a way of seeing may match a single answer; it stays nameless, but someone who knows you well might recognise your idea. Write knowing this.
- The percentages of each way of seeing are shown by default. The person sharing a Subject can hide them; once someone has answered with percentages hidden, they can no longer be shown for that share.
- Your Portrait is only visible to you. Your profile can only be found by others if you chose so (adults only).
- Your messages are visible to the people in the conversation.
- The KiftMe team only reads a Subject, an answer or a message when it is necessary: a report, a safety check (for example a threat), an assistance request you send us, or a legal obligation. This access is limited to a few people, with two-factor authentication.
8. The Mirror, the Portrait and artificial intelligence#
The Mirror, Subject themes and some wording are produced with the help of artificial intelligence, from what people expressed. To do this, your Subjects and answers are sent to artificial intelligence services run by other companies (Anthropic, OpenAI, TypeSafe), which process them on our behalf; the full list is in the privacy policy. You accept this by ticking the box when you sign up. Before anything is sent, we remove contact details (email, phone, address, links, @names).
A way of seeing is a summary, never a quote: a text that would repeat a run of words from an answer is rejected. The Mirror may be incomplete, place an answer in the wrong group or be wrong; it changes as new people answer. Under your answer, “Is this you?” lets you say it is not in the right place.
KiftMe Plus analyses (by age, gender, place, emotion or argument) are estimates. They rely on what people declared (age, gender), on a city that is sometimes approximately inferred, and on a sorting done with the help of artificial intelligence. A person may therefore be counted in the wrong group, and percentages may be inaccurate. Do not make any important decision based on these results alone. For emotions, this is the tone of what was written (for example joy or worry in the words), not what the person feels: no one can know that for them.
Your Portrait only contains the answers you chose to add (“In my Portrait”). Removing an answer takes it out of your Portrait; deleting it also removes it from the Mirror.
Neither the Mirror, the Portrait nor Resonances are a diagnosis or advice (medical, psychological, legal or otherwise). If you are going through a hard time, contact emergency services (112 in Europe, 911 in the United States) or a helpline in your country.
9. Resonances and messages#
KiftMe may suggest a person whose answers resonate with yours (shared subjects, close positions, close age, city or country). Before answering, you see their first name, username, photo, bio and the Subject that brings you together.
- You can say yes, or “Not now”. The other person is never told you declined. The same suggestion does not come back for 30 days, and an unanswered suggestion disappears after 14 days.
- A conversation only opens if you both say yes.
- Your two answers to the shared Subject are only shown to each other if you both agree. Once shown, this cannot be undone.
- From 15 to 17, Resonances only connect people aged 15 to 17; between adults, a first Resonance connects people of similar ages.
- You can turn Resonances off in Settings, mute a conversation, leave it, block or report the person.
10. Images, videos and links from other sites#
A Subject may contain your images or link to a page, a YouTube or TikTok video. For a link, we keep its address, title, author and the address of its preview image; we do not copy the video. The other site’s player only loads if you tap “Play”.
What a link contains belongs to its author and remains subject to that site’s rules: sharing a link does not make you its owner. Do not present someone else’s work as yours, and do not add an image of a person who would not agree. We are not responsible for the sites a link leads to.
11. What is not allowed#
The KiftMe Rules are part of these terms. In particular, you may not:
- post sexual content involving a minor, sexualise a minor, ask a minor for photos, try to approach a minor to manipulate them (grooming) or blackmail them (sextortion), in any way;
- harass, threaten, humiliate or incite hatred;
- post other people’s personal information (address, phone, school…) or intimate images of someone without their consent;
- scam, spam or impersonate anyone;
- encourage self-harm or suicide;
- post illegal content or content that infringes other people’s rights, including copyright;
- keep contacting a person who said no to you, blocked you or left the conversation;
- get around our protections, try to find out who wrote an answer, mass-extract information from KiftMe or disrupt how it works.
12. Reports and moderation#
Reporting: the “Report” menu is on a Subject and its creator, a private link, a profile, a message, the note attached to a Resonance and an answer that was shown to you (an account is needed). Without an account, write to us with the Help form; for copyright, use the dedicated form. Your identity is never shared with the person reported. A report alone is never enough to sanction anyone.
How we decide: automatic checks review Subjects, images and answers; they may hold a Subject before it is published or keep an answer out of the Mirror. Reports are reviewed by the team, those about a minor’s safety or a threat first. We may remove or restrict any content, or suspend any account, that breaks these terms or the law, with no obligation to monitor everything that is posted.
What you receive: when a decision affects your content or account, you receive a notice saying what is affected, the rule involved, and whether an automatic check made the decision first.
Sanctions: depending on severity and repetition, a warning, then a 3, 14 or 30-day suspension. Sexual content involving a minor is removed at once; as soon as the team confirms it, the account is suspended and its closure reviewed. Permanently closing an account is always decided by a person.
Appeals: you can appeal any decision, for free, from the notice you received. Another person on the team reviews your request and answers you. If the decision was a mistake, everything is restored. You can also go to court.
If content shows a danger to someone’s life or safety, or child abuse, we may report it to the authorities, and we do so when the law requires it.
13. Blocking someone#
You can block a person from their profile, a conversation, a Resonance or the Subject they created. They are not told. Then:
- your conversation closes and you can no longer write to each other; in a group conversation, you no longer see each other’s messages;
- no Resonance is suggested between you any more, and pending ones disappear;
- your profiles are hidden from each other and you no longer find each other in people search;
- they can no longer join your private links.
Your public Subjects stay visible to everyone, them included, but without your name. Unblocking does not reopen the conversation or bring Resonances back.
14. Intimate images posted without consent#
If an intimate image of you (or of a person you represent) was posted without consent, report it with the “Report” menu or write to [email protected] with the subject “Intimate image removal”, the link to the content, a statement that the image was posted without consent, and your signature (your typed name is enough). We remove it within 48 hours at most, along with identical copies we know of.
15. Copyright#
If you hold rights in a work posted on KiftMe without permission, use the notice form. It asks for what we need: the work, the content at issue, your contact details, a good-faith statement and your signature.
United States (DMCA): notices may also be sent to our designated agent: Copyright Agent, KIFTME LTD, 20 Wenlock Road, London, N1 7GU, United Kingdom - +33 7 64 06 42 64 - [email protected] (registration DMCA-1084704 with the U.S. Copyright Office).
Challenging a removal: if your content was removed by mistake, appeal the decision from the notice you received, or send a counter-notice to the same address with: the removed content and where it appeared, a statement under penalty of perjury that it was removed by mistake or misidentification, your name, address and phone number, your consent to the jurisdiction of the competent courts, and your signature. We forward your counter-notice to the person who sent the notice and restore the content within 10 to 14 business days, unless they tell us they have gone to court.
Repeat infringers: the account of anyone who repeatedly infringes other people’s rights is closed.
16. KiftMe Plus#
The KiftMe Plus subscription, for adults only, is governed by its terms: price, monthly renewal, cancellation at any time and a 14-day right of withdrawal. Payment is handled by Stripe on the web, or by the App Store and Google Play in the apps; a subscription taken in an app is managed in your phone’s settings.
Subscribing gives access to no one’s answer and changes nothing in the rules: sanctions apply the same way.
17. Our ads#
There are no ads inside KiftMe. To become known, KiftMe runs ads on other services (Facebook, Instagram, TikTok). What you post is never used in these ads and is never passed to these services.
If you accept advertising in the cookie choice, and only if you are 18 or over, we tell Meta and TikTok whether you came from one of our ads and five steps of your journey (creating your account, creating a Subject, a Subject that 3 other people answered, opening the KiftMe Plus payment, your first KiftMe Plus payment), to measure how well our ads work. The details are in the privacy policy; you can withdraw your consent at any time in the cookie policy, with no effect on your use of KiftMe.
18. The service, availability and our liability#
KiftMe is free, except KiftMe Plus. We keep improving the service: features may change or disappear; if a KiftMe Plus feature disappears, its terms say what happens. We do our best to keep it running without interruption, but it may be interrupted for maintenance or in case of failure.
We are not responsible for what other people post, nor for the sites a link leads to. Nothing in these terms limits the rights your country’s law gives you as a consumer, or our liability for gross negligence, personal injury or where the law does not allow it to be limited.
19. Suspension, termination and deletion#
Taking a break: from Settings, your account is hidden while paused; when you come back, you reactivate it in one step.
Deleting your account: from Settings → Take a break or leave, on the website and in the app, without having to write to us. For 90 days, you can still change your mind; a reminder is sent 7 days before the end. After that, your account and information are erased as described in the privacy policy: a Subject others answered remains, without your name; messages others wrote to you remain in their conversation.
What about KiftMe Plus? When you request deletion, a subscription taken on the web or on Google Play is no longer renewed (you keep it until the end of the paid period). A subscription taken on the App Store must be cancelled in your iPhone settings: Apple does not let us do it for you, and the deletion screen takes you there.
On our side: we may suspend or close an account that seriously or repeatedly breaks these terms, explaining why, unless the law or someone’s safety prevents it. During a suspension, you can no longer post or write; your information is kept as for any account.
20. The mobile apps#
We grant you a personal, non-exclusive, non-transferable right to install and use the KiftMe apps on devices you own or control, for your personal use. You may not copy, modify, resell or try to extract their code, except where the law allows it.
If you downloaded the app from the App Store, Apple’s standard Licensed Application End User License Agreement also applies to the app itself. Apple and Google are not responsible for KiftMe, its support or its content: KIFTME LTD is. Apple and its subsidiaries may, however, enforce that licence agreement.
21. Changes to these terms#
If these terms change significantly, we will tell you in the app or by email before the change applies, and ask you to accept them again where needed. If you disagree, you can delete your account. The date at the top of the page shows the version in force.
22. Governing law and disputes#
These terms are governed by the law of England and Wales. If you are a consumer, you keep the protection of the mandatory rules of the country where you live and may bring a claim in its courts.
If something goes wrong, write to us first from Settings → Assistance or at [email protected]: we will look for a friendly solution.
California: under Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the Department of Consumer Affairs, 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, (800) 952-5210.
23. Contact us#
Members: Settings → Assistance (you choose the topic, can attach a screenshot, and the team answers you in the app and by email). Without an account: the Help form. By email: [email protected], in French or English.
This address is also our point of contact for users and authorities under the EU Digital Services Act (DSA). More in the legal notice.
